BENNINGTON TOWNSHIP
Regular Board Meeting

The Bennington Township regular board meeting was called to order by Supervisor Lee Ash on September 4, 2019, 7:00pm, at the Township Hall.
Present: Jim Forsythe, Matt Dutcher, Lee Ash, Nancy Zdunic, Donna Ash.

L. Ash moved to approve the agenda with the addition of Nancy Zdunic. Second by Forsythe. Motion carried.
Forsythe moved to approve the minutes for the August 5, 2019 regular board meeting as printed. Second by Zdunic. All board members in favor. Motion carried.
Forsythe moved to approve the minutes for the August 20, 2019 special board meeting as printed.
Second by Zdunic. All board members in favor. Motion carried
Forsythe moved to accept the Treasurer’s report as presented. Second by L. Ash. All board members in favor. Motion carried.
Forsythe moved to pay bills as presented in the amount of $9,390.57. Second by Zdunic. All board members in favor. Motion carried.

Public Comment:
Question regarding the Township Junk Ordinance.

Board Reports:
Plan Comm – D. Ash – Recommended approval of two variances.

• Forsythe moved to concur with the Township Planning Commission and approve Variance Request #PZBA19-021 for Thomas & Shannon Hinterman, parcel #010-12-200-001-02, to allow the creation of a parcel located in the A-2 zoning district that exceeds the maximum lot size requirements of 2.5 and is less than 20 acres in size. Second by Dutcher. All board members in favor. Motion carried.
• Forsythe moved to concur with the Township Planning Commission and approve Variance Request # PZBA19-024 for Maxwell Ellenberg, parcel #010-15-400-001-11, to allow an addition to a single family residential structure which encroaches approximately 45’ into the requires 100’ waterfront setback. Second by Zdunic. All board members in favor. Motion carried.

Roads – L. Ash –  Chip & Seal is complete, Crack fill and gravel yet to be done. There will not be a second application of Mineral Well Brine. 

Unfinished Business:
Parking Lot Repairs – Hold for spring.
Recreational Marijuana Ordinance – Dutcher moved to adopt Ordinance # 19-09-01 Prohibition of Recreational Marijuana Establishment’s Ordinance . Second by L. Ash. Roll call vote: Forsythe- yes, D. Ash- yes, Zdunic- yes, L. Ash –yes, Dutcher- yes. Motion carried.  (Complete wording of the Ordinance is available at the Township Hall. The Ordinance shall take effect 30 days after publication.)
Assessor Position – L. Ash moved to hire Ilene Stead as the Township Assessor at a salary rate of $20,000 per year. Second by Forsythe. All board members in favor. Motion carried.

New Business:
L-4029 Approval – Forsythe moved approve the L-4029 and levy 2019 tax rates at Fire – 1.0 mill, SATA – 0.11mills and Operating at the maximum mills allowed. Second by L. Ash. All board members in favor. Motion carried.
Nancy Zdunic – Informed the board that she will be leaving her Trustee position at which time her house is sold.

Forsythe moved to adjourn. Second by L. Ash. Motion carried.
