July 2, 2018
The Bennington Township regular board meeting was called to order by Supervisor Lee Ash on July 2, 2018, 7:00pm, at the Township Hall.
Present: Matt Dutcher, Cindy Garber, Lee Ash, Nancy Zdunic, Donna Ash.
L. Ash moved to approve the agenda as printed. Seconded by Dutcher. Motion carried.
Dutcher moved to approve the minutes for the June 4, 2018 regular board meeting with the addition of ORV Ordinance discussion. Seconded by L. Ash. All board members in favor. Motion carried.
L. Ash moved to approve the Treasurer’s report as presented. Seconded by Zdunic. All board members in favor. Motion carried.
Zdunic moved to pay bills as presented in the amount of $34,297.33. Seconded by Dutcher. All board members in favor. Motion carried.
Public Comment:
Jeff Aspsey Candidate for Shiawassee County Road Commission
Jeff Bartz, Co Comm. – Updated the board on County Activities.
Board Reports:
Library – Garber – Approved library audit.
Plan Comm – D. Ash – Reviewed Zoning Amendments.
Dutcher moved to recommend that County Zoning Amendment Section 4.3.43, Kennels, Commercial increase the height requirement of fenced enclosures from (4) four feet to (6)six feet in height and recommend that County Zoning Amendment Section 5.3.1, Accessory Buildings and Structures setback requirements sections B.1.a.iv and B.1.b.v should be from property lines. Seconded by L. Ash. Motion carried. The board has concerns that a four foot fence is not high enough for some dogs. The board believes that a setback requirement from a structure on an adjacent property incurs unfair limitations on future structures on the adjacent property.
Roads – L. Ash – Fog seal is now complete, starting gravel projects.
Hall Parking Lot- Estimates were received to crack fill and seal the asphalt of the Hall parking lot and repaint lines and repair/fill hole in asphalt driveway at Oakwood Cemetery. E.Z. Asphalt , total cost of $3350. Kickin’ Asphalt, total cost of $1780. Zdunic moved to have Kickin’ Asphalt crack fill and seal asphalt parking lot and repaint line of the entire parking lot and fill/repair the hole in driveway at Oakwood Cemetery at a total cost of $1780. Seconded by Dutcher. All board members in favor. Motion carried.

New Business:
Sheriff’s Department Township Patrol – Sheriff Brian BeGole addressed the Board with a proposal to provide additional patrol within the Township using the funds the Township has budgeted. L. Ash moved to contract with the Shiawassee County Sheriff’s Department for additional road patrol within Bennington Township per the parameters of the contract at a total cost of $5000. Seconded by Zdunic. (Complete contract is available at the Township Hall.)
SATA Commitment – Dutcher moved to commit to the Shiawassee Area Transportation Agency for service for the term of October 1, 2018 –September 30, 2019 at a maximum cost of $15,916.31 pending the Millage approval on the August 7, 2018 ballot. Seconded by Zdunic. All board member in favor. Motion carried.
ORV Ordinance – Dutcher moved to recommend to Shiawassee County that the ORV Ordinance have clearer language regarding operating with a valid driver’s license and that the County require Liability Insurance on the vehicles. Seconded by D. Ash. Roll call vote: Zdunic- yes, D. Ash – yes, Garber – no, Dutcher – yes, L. Ash – yes. Motion carried.
L. Ash moved to adjourn. Seconded by Zdunic. Motion carried.
